Specifications and How They Are Recorded
Brochure language is generally not enforceable. An overview of how specifications are documented and checked.
Updated

Descriptions such as premium fittings, branded tiles and high-quality wiring are generally identified as unenforceable.
What is described as recorded instead is a specification schedule annexed to the agreement naming the actual item for each element: flooring type, size and grade; bathroom fittings and sanitaryware by brand and range; kitchen counter material; window and door frames; wiring and switch brands; paint type; lift make; generator capacity; and water treatment provision. Where a brand is stated, wording permitting substitution only with the allottee's approval rather than at the developer's discretion is the formulation described.
At handover, each item is checked against the schedule and photographed, with differences recorded in the snag list before the possession letter is signed.
Common area specifications - lifts, generators, pumps, the STP and fire systems - are identified as carrying more consequence than unit finishes and as the items most frequently altered, with make and capacity obtained in writing.
The distinction generally drawn is between a specification in the agreement, which is contractual, and one in a brochure, which developers commonly reserve the right to vary.
