Consequences of Late Maintenance Payment
Associations may charge interest and pursue recovery; essential services are treated differently. An overview.
Updated

What associations may ordinarily do is charge interest on arrears at the rate specified in the bye-laws, issue written demands and a legal notice, and pursue recovery through the appropriate forum. Restriction of genuinely discretionary amenities may be permissible depending on the bye-laws, and is described as a grey area on which advice is generally taken.
What sits on weaker ground is disconnection of water, electricity or lift access as a coercive measure, courts and consumer forums having consistently taken an unfavourable view of the denial of essential services, with potential exposure for office bearers. Published lists of defaulters are similarly identified as carrying their own difficulties.
For residents, payment through a standing instruction is the practice described, most defaults being administrative rather than deliberate, and where payment is withheld over a service failure, recording the reason in writing rather than remaining silent, silence resembling default.
For committees, a written and uniformly applied policy, formal escalation on a schedule, and resolution of underlying service complaints, unresolved grievances being reported as spreading into justifications for non-payment.
For purchasers, a no-dues certificate is requested before purchase, arrears attaching to the property.
