Assignment of an Under-Construction Booking
Rights under an allotment can be transferred before registration, subject to consent and conditions. An overview of the mechanism.
Updated

Where a buyer holding an under-construction allotment wishes to exit before the sale deed is executed, what is transferred is the buyer's rights under the allotment or agreement rather than the property itself. That transfer is generally effected through an assignment.
Four factors govern whether it is practical.
Developer consent. Most agreements require written approval, and many provide for a transfer fee, in some cases calculated per square foot. The clause is generally examined at the point of booking rather than at the point of exit.
Stage restrictions. Some agreements preclude transfer until a proportion of the consideration has been paid, or within an initial period.
Lender involvement. Where a loan is running against the booking, the lender is party to the arrangement and the loan is settled or transferred.
Applicable levies, which are assessed according to the circumstances and the relevant dates.
Assignment markets are noted as liquid in projects performing well and illiquid in those that are not - itself information, since an absence of interest in taking over a booking at cost reflects the market's assessment of the project.
